Terms of Use

Welcome to Cultiveight Connect (the “Membership”), a fractional consulting and resource-sharing community hosted on Circle.so and operated by Cultiveight Communications, LLC (“we,” “us,” or “our”).

By joining or participating in the Membership, you agree to these Terms of Use. If you do not agree, do not use or participate in the Membership.

1. Membership Structure

- Membership is billed month-to-month, with a minimum two-month initial commitment.
- After the initial two months, you may cancel with 7 days’ written notice prior to your next billing cycle. To cancel, please email membership@cultiveightconnect.com.
- All sales are final. No refunds will be issued for partial months or unused membership periods.

2. Our Services

We offer fractional consulting, expert-led workshops, resource sharing (templates, guides, etc.), live Zoom events, and guest expert contributions. The exact nature and format of these offerings may change from time to time at our sole discretion.

3. Intellectual Property

All content we provide—including templates, guides, recordings, videos, articles, tools, and any related materials—is protected by copyright and intellectual property laws. You may not copy, distribute, modify, share, or reproduce any content outside the Membership without our express written permission.

4. User Contributions and Third-Party Content

We may allow members, guest speakers, or other third parties to contribute content. We do not endorse or take responsibility for such content, nor are we liable for any harm or reliance on it.

5. Guest Experts

Guest experts may present views or advice during sessions. These are solely their own and do not reflect our opinions or endorsement. We are not liable for any statements or content shared by any guest or third party.

6. Limitation of Liability

This Membership is provided “as is.” Your sole and exclusive remedy for dissatisfaction is to terminate your membership. We shall not be liable for indirect, incidental, or consequential damages arising from your participation.

7. Changes to the Terms

We reserve the right to modify these Terms at any time, with notice via the platform or email. Continued participation constitutes agreement to any revised Terms.

8. Membership Account Use

Each membership account is intended for use by a single individual only. You may not share, transfer, or allow others to access your account or Membership benefits. Any shared or unauthorized use of an account is grounds for immediate termination of your Membership without refund.

9. Termination

We reserve the right to immediately terminate your Membership at our sole discretion if we determine, in good faith, that you have violated these Terms of Use or engaged in any conduct that is harmful, disruptive, or inconsistent with the spirit of the Membership. No refund shall be issued upon termination under this provision.

10. Member Conduct and Contributions

You agree to behave respectfully and professionally in all interactions within the Membership community, including live events, message boards, comments, and private messages. You agree not to:
- Harass, threaten, abuse, or intimidate others
- Post or share unlawful, offensive, or misleading content
- Impersonate another person or misrepresent your affiliation
- Use the Membership to promote or solicit unrelated commercial ventures
We reserve the right to remove any content or restrict participation at our discretion.

11. Indemnification and Release

You agree to indemnify, defend, and hold harmless Cultiveight Communications, LLC, its owners, affiliates, agents, contractors, and employees from and against any and all claims, damages, liabilities, losses, and expenses (including legal fees) arising from your participation in the Membership or your violation of these Terms of Use.
You also release us from any claims or liabilities related to your use of or reliance on any content, advice, or resources provided in the Membership.

12. Limitation of Liability

To the fullest extent permitted by law, we disclaim all liability for any indirect, incidental, consequential, or special damages arising out of or in connection with your participation in the Membership. Our maximum liability under any circumstances shall not exceed the total amount you have paid for your Membership in the twelve (12) months preceding any claim.

13. Governing Law and Venue

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising out of or related to the Membership shall be brought exclusively in the state or federal courts located in Manatee County, Florida, and you consent to the jurisdiction and venue of such courts.

14. Business Hours

Our business hours are Monday through Friday, 9:00 a.m. to 5:00 p.m. Eastern Standard Time (EST). Responses to inquiries or support requests will generally be handled during these hours.
